User Agreement

What the service is

Turnexify gives an appointment business a public page, a booking system, a client record, and a way to take payment. We provide the software. You provide the business, the work, and the relationship with your clients.

Your account

You are responsible for what happens under your account, including anything done by people you invite to your team. Keep your password to yourself and tell us promptly if you think someone else has it.

You must give us accurate details and keep them current. You must be old enough to enter a contract where you live.

Plans and payment

• Turnexify Free costs nothing and stays free. A card is placed on file when you start, and nothing is charged to it unless you move to a paid plan.
• Turnexify Pro is $49 per month, or $504 per year. Turnexify Business is $129 per month, or $1,320 per year. A yearly plan works out to $42 and $110 a month respectively, a saving of 14% and 14% against twelve monthly payments. Prices are in US dollars and do not include any tax that applies where you are.
• A monthly plan renews each month and a yearly plan renews each year, until you cancel. A yearly plan is paid in full at the start of each year. You can cancel at any time and keep access until the end of the period you have paid for.
• We do not refund part of a month or part of a year. If you move up to a bigger plan in the middle of a period, Stripe charges the difference for the days that remain. If you move down, the change takes effect at the next renewal.
• If we change a price we will tell you at least 30 days before it applies to you. A price change never applies to a yearly period you have already paid for.
• If a payment fails we may suspend the paid features. Your data stays and comes back when payment succeeds.

Money your clients pay you

Payments from your clients are processed by the card processor you connect, Stripe or Square, and paid into an account you control. We never hold your money.

Your use of Stripe or Square is governed by that processor’s own agreement with you. Deposits, refunds, chargebacks, and disputes with your clients are between you, your client, and your processor. We will help where we can, but we are not a party to those transactions.

Your content stays yours

The photographs, words, prices, and client records you put into Turnexify remain yours. We claim no ownership of them.

You give us the permission we need to run the service: to store your content, to display it on your public page, and to send it to the people you tell us to send it to. That permission ends when you delete the content or close your account.

Your clients are your responsibility

You decide what to collect about your clients, what to tell them about it, and how long to keep it. You are responsible for having the right to collect it and for honouring their requests about it.

Your booking policy, your cancellation terms, and your deposit rules are yours. We show them and enforce them as you set them; we did not write them.

What you may not do

• Use Turnexify for anything illegal, or to sell anything you are not licensed to sell.
• Upload content you do not have the right to use, or content that is unlawful.
• Send marketing to people who did not ask for it.
• Try to reach another business’s data, probe our systems, or work around the limits of your plan.
• Resell the service, or use it to build a competing product.

Availability

We work to keep Turnexify running and we do not promise it will never be down. We may take it offline for maintenance, and we will keep that short and give notice when we can.

We may change features. If we remove something you rely on, we will tell account holders first.

No warranty

The service is provided as it is. To the extent the law allows, we make no warranties of any kind about it, including that it will be uninterrupted, error free, or fit for a particular purpose.

Limits on what we owe you

To the extent the law allows, AxionLabs is not liable for indirect, incidental, or consequential loss, including lost bookings, lost revenue, or lost data. Our total liability to you for any claim is limited to what you paid us in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law.

Ending the agreement

You can close your account at any time. We will delete your data on request; see the privacy notice for what we must keep and for how long.

We can suspend or close an account that breaks these terms, does not pay, or puts other customers at risk. Where it is reasonable to do so, we will warn you first and give you a chance to fix it.

Changes to these terms

When these terms change, the date at the top changes with them. If a change materially affects your rights, we will tell account holders by email at least 30 days before it takes effect. Continuing to use the service after that means you accept the new terms.

Governing law

This agreement is governed by the laws of the State of New Jersey, United States, without regard to conflict of law rules. Disputes go to the courts of that state.
